Customary Norms, General Principles of International Environmental Law, and Assisted Migration as a Tool for Biodiversity Adaptation to Climate Change

چکیده

Assisted migration (AM) is a translocation of the representatives species to areas outside their natural habitats as response climate change. This article seeks identify how customary norms and general principles international environmental law could guide development regulation AM maximizing benefits using minimizing AM-related risks. Among discussed in relevant are permanent sovereignty over resources, principle cooperation, no-harm rule, precautionary principle, prevention, due diligence, obligation conduct impact assessment (EIA), integration intergenerational equity, common but differentiated responsibilities, polluter pays non-regression, progression, resilience, dubio pro natura, ecological proportionality, access information, public participation, justice matters (principle good governance, democracy).
